Welcome to Brainstorm Kit. These terms are simple: use the tool, pay $1 to export, and take full responsibility for what you do with it. We're not your lawyers, consultants, or insurance policy.

By using BrainstormingApp.ai ("the Service"), you agree to these Terms & Conditions. If you don't agree, don't use it.

1. Who We Are

This Service is operated by SDG Foods LLC, located in Jersey City, NJ, USA.

2. The Service

What we provide:

• Free access to AI-powered brainstorming triggers
• $1 one-time payment to export your brainstorm results

What we don't provide:

• Guarantees that the Service will always work
• Liability for anything that happens because you used it
• Professional advice, consulting, or recommendations
• Promises that AI outputs will be accurate, useful, or appropriate

3. How It Works

• Free to use: Generate brainstorming triggers at no cost
• $1 to export: Pay once to download your completed brainstorm with AI-generated "Yes, And..." responses
• Payment: Processed securely via Stripe
• No refunds: All sales are final. The $1 export fee is non-refundable.

4. Your Content, Your Responsibility

You own your content. We claim zero rights to your inputs, ideas, or exported brainstorms.

You are responsible for everything you do with the Service, including:

• How you use the AI-generated triggers and suggestions
• Any ideas you implement based on the outputs
• Any harm, damage, or legal issues that result from using the outputs
• Ensuring your use complies with all applicable laws

We are NOT responsible for:

• How you use, misuse, or apply the content generated by the Service
• Any damages caused by implementing ideas from the Service
• Any legal, financial, or reputational harm resulting from your use

5. AI Outputs & Third-Party Services

AI Provider: This Service uses Google Gemini AI to generate content.

Important disclaimers:

• AI-generated content may be inaccurate, inappropriate, biased, or offensive
• We do not review, edit, or verify AI outputs
• You use AI-generated content at your own risk
• Your inputs are processed by third-party AI providers (Google Gemini)
• We are not responsible for how third-party services handle your data

Payment Processing: Payments are processed by Stripe. We do not store your credit card information. Stripe's terms and privacy policy apply to all payment transactions.

6. What You Can't Do

You agree NOT to:

• Use the Service for illegal purposes
• Generate content intended to harm, defame, or harass others
• Scrape, automate, or abuse the Service
• Attempt to hack, reverse-engineer, or compromise the Service
• Use the Service if you're under 18 years old
• Share your account credentials with others
• Resell or redistribute outputs as a commercial service

Violation = Immediate termination. No refunds.

7. Zero Liability (This Is Important)

THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES.

We are NOT liable for:

• Data breaches, hacks, or unauthorized access to your account
• Loss of your data, brainstorms, or exported content
• Service downtime, errors, bugs, or unavailability
• Inaccurate, offensive, or harmful AI-generated content
• Any damages (financial, legal, reputational, or otherwise) from using the Service
• Third-party actions (payment processors, AI providers, hackers, etc.)
• How you use or misuse the outputs from the Service

Maximum liability: If we are somehow held liable, our total liability is limited to the amount you paid us (i.e., $1).

You use this tool at your own risk. Period.

8. Data & Privacy

What we collect:

• Email address (for account access)
• Payment information (processed by Stripe, not stored by us)
• Brainstorm content (stored for 6 months)
• Usage data and analytics

Data retention:

• We store your brainstorm data for 6 months
• You can delete your account and data anytime from your settings
• Deleted data cannot be recovered

Security:

• We use reasonable security measures, but we cannot guarantee your data will never be compromised
• If there's a data breach, we are not liable for any resulting damages

9. Account Termination

We can terminate your account anytime, for any reason, without notice.

Reasons we might terminate:

• Violation of these Terms
• Abusive behavior
• Suspected fraud or illegal activity
• Or no reason at all—it's our discretion

If we terminate your account:

• You lose access immediately
• No refunds for any exports purchased
• We may delete your data

10. Changes to the Service

We can:

• Modify, suspend, or shut down the Service anytime without notice
• Change the $1 export fee to a different price
• Add or remove features
• Update these Terms without your approval

If we make changes:

• We'll update the "Last Updated" date at the top
• Continued use means you accept the new Terms
• We're not required to notify you of changes

11. Disputes & Legal Stuff

• Governing Law: These Terms are governed by the laws of the State of New Jersey, USA.
• Jurisdiction: Any legal disputes must be resolved in the state or federal courts located in Hudson County, New Jersey. You agree to submit to the personal jurisdiction of these courts.
• Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive your right to participate in class-action lawsuits or class-wide arbitration.
• Attorney's Fees: If we have to take legal action to enforce these Terms, the losing party pays the winning party's attorney fees and costs.

12. Miscellaneous

• Entire Agreement: These Terms are the complete agreement between you and SDG Foods LLC.
• Severability: If any part of these Terms is invalid, the rest remains in effect.
• No Waiver: Our failure to enforce any provision doesn't waive our right to enforce it later.
• Assignment: We can transfer these Terms to another entity. You cannot.
• Force Majeure: We're not liable for failures caused by circumstances beyond our control (hacks, outages, natural disasters, etc.).

13. Age Requirement

You must be 18 years or older to use this Service. By using it, you confirm you meet this requirement.
